rcz cooling off Period and wrong options

So to begin the nightmare story of my girlfriends new car order (done through a broker). So 7th sept ordered RCZ 156 GT auto in white. sat nav and zenons light package and full black interior she was given fist build date 24/10/11. Got to 24/10/11 then to be told built date had to be pushed back to 24/11/11. She then got told she should have the car begging of dec 11th or 12th at the latest. she got to 12/12/11 then to be told the car has now been delivered but can not pick the car up until 17/12/11. so then we then got a phone call at 4:30pm on 16/12/11 that you cannot pick up the car until the 2 week cooling off period on the car finance has passed but you can go and see the car. i Believe the finance was signed around 15/12/11. so we drove to ***** peugeot to look at the car as soon as i saw the car i noticed straight away that the car had light grey leather seats and not fully black as she ordered. So now they are in the process of ordering a new black interior for the car. (said it should be sorted before christmas) So i work for a bank and never have a heard of anyone having to wait for 2 week cooling of period before you get the car. (serious breach of FSA requirements me thinks) the finance is an option with a large balloon payment at the end. Please let me know your thoughts and opinions. Thanks

really what can you do :eusa-think: cancel or keep the car the light grey leather is very nice :thumbup: and the black leather aint black its grey,you have been unlucky with this hassle many people have had to wait 3 or even 4 months sometimes 5 months for a factory order :( but the colour and options you ordered at least there correct :thumbup: small mercys i know but if its really down to the colour of leather thats bothering you i wouldnt let them change it as they will just swap it from another rcz gt,it wont be reupholstered this can only be down at the factory so un bolting and climbing about the interior disconnecting electric seats.........and so on then having to redo it all by a dealer i wouldnt let them anywhere near the interior.

choice is yours :eusa-think:

So they've really got you by 'the short and curlies' then. I would've questioned that condition before I even signed up. Maybe your lucky its only the leather thats the problem (if REALLY a problem). Guess its easy to be wise after the event though.Hope you get everything sorted out and go on to love your RCZ .... after all it's not its fault :)

Spoke with fsa and hire purchase doesn't fall under same regulations it falls under office of fair trading. So two week cooling off period seems to be an allowed clause in terms and conditions of the hire purchase. Keep fingers crossed

Fingers crossed good news should be able to get the rcz on Thursday.

The finance agreement is covered by the European consumer credit directive. The deal for the car and the finance agreement are two separate entities under the ECD. You have the right to cancel the finance agreement within the 1st 14 days of it being active....this however is only a cancellation of the contract for the finance not the contract for the car. If a customer cancels the finance in the 14 days they are required to pay the finance company in full for the car within 30 days, they still have to take the car ( this would be detailed in the SECCI document you would have received when you signed the finance docs). In your case the distance selling regulations may also have applied if you had never been to the dealership (you said the deal was via a broker) but this was negated by your visit the dealership to examine the car. The fact that the car they were supplying wasn't as ordered would have also been pertinent but your dealer has come up with a resolution which you have accepted ( I.e the trim swap)

In summary the dealer is putting the error right , welcome to the forum and enjoy your new RCZ :thumbup:

I have never heard of buying a car through a broker. How does that work? Why would you? What are the pros and cons of so doing? Sorry for so many question when you are seeking answers, but you have made me rather curious.

Hi Sir elton :thumbup: a car broker is much like a mortgage broker but on-line they find the best deals/finance deals but without the showroom involved for you just like my leasing deal :eusa-think:

Ron, you can pick up a new car (sometimes a pre-reg) for much less than a dealer. I considered it, but I needed my car as a deposit and being a lass, I didn't fancy selling it privately, so I went down the usual trade-in route.

Such websites are ukcarbroker, drivelthedeal, uk-car-discount ...... have a look......

Pros being that the broker dealt with selling her old car sorted finance out and got brand new car with £3k saving. however the cons are in my original post. as you can see things havent gone so smoothly.
